Terms & Conditions
1. Acceptance of Terms
By accessing or using the LATAM Medical Network platform and services, you agree to be bound by these Terms & Conditions. If you do not agree, do not use our services.
2. Description of Services
LATAM Medical Network provides insurance billing, claims processing, eligibility verification, and pre-authorization services to healthcare providers globally for US-insured patients. Services are subject to the specific plan selected during registration.
3. Provider Responsibilities
You agree to provide accurate and complete information for all claims submitted through our platform, maintain appropriate licenses and credentials for your jurisdiction, and cooperate with payer audit requests and documentation requirements.
4. Fees and Payment
Our services are performance-based. Fees are calculated as a percentage of collected amounts and deducted from claim proceeds prior to remittance. The applicable percentage is established in your service agreement. There are no upfront fees or monthly minimums.
5. Prohibited Uses
You may not use our platform to submit fraudulent claims, misrepresent services provided, circumvent payer requirements, or engage in any activity that violates applicable law, including the False Claims Act.
6. Termination
Either party may terminate the service relationship with 30 days written notice. LATAM Medical Network may terminate immediately for cause, including fraud, misrepresentation, or material breach of these terms.
7. Limitation of Liability
LATAM Medical Network's liability is limited to the fees paid in the three months preceding the claim. We are not liable for payer denials, underpayments, or regulatory actions taken against your practice.
8. Governing Law and Disputes
These terms are governed by the laws of the State of California. Disputes shall be resolved through binding arbitration in San Diego, California, under the rules of the American Arbitration Association.
9. Changes to Terms
We may update these terms from time to time. We will notify you of material changes by email or through the platform. Continued use of our services after changes take effect constitutes acceptance.
